- Does marriage or divorce affect my existing will?
- Yes. Marriage generally revokes a prior will (subject to limited exceptions), and divorce affects gifts to and appointments of a former spouse. Both events warrant a review.
- What is an enduring power of attorney?
- An enduring power of attorney allows a person you trust to make financial or personal decisions on your behalf and continues to operate if you lose capacity. Different documents cover different types of decisions in Victoria.
- Should I consider a testamentary trust?
- Testamentary trusts can offer asset protection and tax planning benefits, particularly where beneficiaries are minors, vulnerable, or in higher-risk occupations. They are not necessary for every estate — we advise where they are warranted.
